Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and YOXON DEV LLC ("we", "us"), the operator of ViberCodify. They govern your use of the ViberCodify website, web application, Agent API, MCP server and command-line interface (the "Service"). By using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

Effective date: [To be confirmed: effective date].

2. Eligibility and accounts

  • You must be at least [To be confirmed: minimum age to use the service] to use the Service.
  • You sign in with GitHub. You are responsible for activity under your account and workspace, and for keeping your GitHub account and any ViberCodify Agent API tokens secure.
  • The workspace owner controls billing, connected repositories and default settings for the workspace.

3. The Service

ViberCodify analyses the repositories you connect, reports findings with their evidence and confidence, calculates a Ship Score, keeps project memory, and generates remediation prompts for coding agents. It does not modify your repositories, commit code, open pull requests or deploy software.

We may change, add or remove features. Features labelled beta or preview may be incomplete.

4. Your content

  • You keep all rights to your code and other content ("Your Content").
  • You grant us a limited, non-exclusive license to access, copy, store and process Your Content, including through the service providers listed in our Privacy Policy, only as needed to provide, secure and support the Service for you.
  • You confirm that you have the rights needed to connect each repository and to let us process it.

5. Acceptable use

You agree not to:

  • use the Service to analyse code you are not authorized to access;
  • attempt to bypass plan limits, rate limits, authentication or workspace isolation;
  • probe, scan or test the Service's security without our written permission;
  • reverse engineer the Service except where the law allows it;
  • resell or provide the Service to third parties without our permission;
  • use the Service in violation of any law.

6. Findings, scores and AI output

Findings, Ship Scores, remediation prompts and other output are automated assessments that help you decide what to review. Some are produced with AI assistance and labelled as model inference. Output may be incomplete or wrong. The Service checks a defined set of issues and does not find every defect or vulnerability. A Ship Score is not a security certification, audit opinion or guarantee that software is safe to deploy.

You are responsible for reviewing output, for any changes you or your coding agents make, and for testing before you deploy.

7. Plans, billing and cancellation

  • The Service offers a Free plan and a Pro plan. Plan limits are shown in the Service.
  • The Pro plan costs US$19 per month, billed in advance through Stripe, and renews automatically each month until cancelled.
  • You can cancel at any time through Manage billing. Cancellation takes effect at the end of the current billing period, and Pro access continues until then.
  • Refunds: [To be confirmed: refund policy]
  • Taxes: [To be confirmed: how sales tax / VAT is charged]
  • We will give at least [To be confirmed: notice period for price changes] notice before a price change applies to an existing subscription.
  • If a payment fails, Pro limits may be paused until payment is updated.

8. Third-party services

The Service relies on third-party services, including GitHub and Stripe, and you may use it alongside coding agents from other providers. Your use of those services is governed by their own terms, and we are not responsible for them.

9. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if your use creates a security or legal risk, or if required by law. Where reasonable, we will give notice first. When an account is closed, we delete data as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY OF OUTPUT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO [To be confirmed: limitation of liability amount].

12. Indemnity

You will indemnify us against third-party claims arising from Your Content, your breach of these Terms or your violation of law, including reasonable legal fees.

13. Governing law and disputes

These Terms are governed by [To be confirmed: governing law]. Disputes will be resolved as follows: [To be confirmed: dispute resolution (courts or arbitration, and venue)]

14. Changes to these Terms

We may update these Terms. We will post the updated Terms on this page with a new effective date. If a change is material, we will notify you before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
